Welcome to VidPulsar! These Terms of Service govern your use of our AI-powered music video creation platform at www.vidpulsar.com and all related services (the "Service").
BY USING VIDPULSAR, YOU AGREE TO THESE TERMS. IF YOU DON'T AGREE, DO NOT USE THE SERVICE.
1. Eligibility
You must be at least 18 years old to use VidPulsar. By using the Service, you confirm that you are 18 or older and have the legal capacity to enter into this agreement.
2. Account Registration
To use VidPulsar, you'll need to create an account. You are responsible for:
- Keeping your account secure
- All activities that occur under your account
- Notifying us immediately at the email address below if you suspect unauthorized access
3. What VidPulsar Does
VidPulsar allows you to create AI-powered music videos, album covers, and visual content by uploading reference images, motion videos, and other media. Our AI technology transforms your inputs into creative visual content.
IMPORTANT: VidPulsar is provided for entertainment purposes only. We make no guarantees about the results or fitness for any particular commercial purpose.
4. Subscription Plans
4.1 Subscription Options
VidPulsar offers multiple subscription plans at different price points to suit various user needs. Current pricing and plan details are available on our website.
4.2 Service Usage
Each subscription plan provides access to generate videos and use other features according to the plan's specifications. Usage limits and costs vary by plan and feature.
4.3 Rollover Rules
- Subscription-based usage allowances DO NOT roll over to the next billing cycle
- Power Pack purchases DO roll over and remain in your account until used
- Unused subscription allowances expire at the end of each billing period
4.4 No Refunds
All payments are final and non-refundable. This includes:
- Subscription fees
- Power Pack purchases
- Any other services or features
Once you purchase a subscription or additional services, there are no refunds under any circumstances, even if you don't use them.
5. Your Content & Responsibilities
5.1 Content Ownership
You retain ownership of all content you create using VidPulsar. However, you are solely responsible for how you use that content.
5.2 Upload Requirements
When you upload any photos, videos, audio, or other content to VidPulsar, you guarantee that:
- You have full legal permission to use everything you upload
- You own the content, OR
- You have explicit permission/licenses from the copyright owner
- Your content does not violate any laws or third-party rights
- No copyright infringement
- No trademark violations
- No privacy violations
- You will not upload content that you don't have rights to use, including:
- Photos or videos of other people without their permission
- Copyrighted images or videos
- Music or audio you don't own or have licenses for
- Brand logos or trademarks without authorization
YOU ARE FULLY RESPONSIBLE for ensuring you have all necessary permissions. VidPulsar is not responsible for any copyright infringement or legal issues arising from your uploads.
5.3 License to VidPulsar
By using the Service, you grant VidPulsar the right to use portions of your created content for our marketing, advertising, and promotional purposes. This means we may:
- Feature your work in case studies
- Use excerpts in social media promotions
- Include your creations in demo reels and promotional videos
6. Prohibited Content & Conduct
YOU MAY NOT create, upload, or generate:
- Any content containing nudity or sexually explicit material
- Content depicting violence or harm to people or animals
- Hate speech, discrimination, or harassment
- Content exploiting or harming minors in any way
- Content promoting illegal activities or substances
- Gambling-related content
- Malware, viruses, or harmful code
- Content that infringes on others' intellectual property rights
YOU MAY NOT:
- Use automated tools, bots, or scrapers to access the Service
- Attempt to reverse engineer or hack the Service
- Impersonate others or misrepresent your identity
- Use the Service for any illegal purpose
- Share your account credentials with others
Violation of these rules will result in immediate account termination without refund.
7. Changes to Terms and Service
VidPulsar reserves the right to modify these Terms or the Service at any time without prior notice. This includes:
- Changing subscription prices
- Modifying usage limits or feature costs
- Adding or removing features
- Updating prohibited content rules
- Any other aspect of the Service
Changes are effective immediately upon posting. Your continued use of VidPulsar after changes means you accept the new Terms.
8. NO WARRANTIES - USE AT YOUR OWN RISK
VIDPULSAR IS PROVIDED "AS IS" FOR ENTERTAINMENT PURPOSES ONLY.
WE MAKE NO PROMISES OR GUARANTEES ABOUT:
- The Service being available at all times
- The quality of AI-generated content
- The Service being error-free or secure
- Results being suitable for commercial use
- Anything working as you expect
YOU USE VIDPULSAR ENTIRELY AT YOUR OWN RISK.
9. Limitation of Liability
VIDPULSAR, ITS OWNERS, EMPLOYEES, AND AFFILIATES ARE NOT LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM YOUR USE OF THE SERVICE.
This includes but is not limited to:
- Lost profits or revenue
- Data loss
- Copyright claims from your uploaded content
- Any issues with content you create
- Service interruptions or errors
- Any other indirect, special, or consequential damages
MAXIMUM LIABILITY: If VidPulsar is found liable for anything, our total liability is limited to the lesser of:
- The amount you paid us in the last 12 months, OR
- $100
10. Your Responsibility for Your Content
YOU ARE SOLELY RESPONSIBLE FOR:
- All content you create using VidPulsar
- How you use that content
- Any legal issues arising from your content
- Any copyright or trademark claims
- Any consequences of your actions
VidPulsar is not liable for:
- How you use content created on our platform
- Legal issues from your uploads or creations
- Third-party claims related to your content
- Any damages resulting from your use of AI-generated content
11. Indemnification
You agree to defend and indemnify VidPulsar from any claims, lawsuits, or damages arising from:
- Your use or misuse of the Service
- Content you upload or create
- Your violation of these Terms
- Your violation of any laws or third-party rights
- Copyright or trademark infringement claims
12. Account Termination
VidPulsar may terminate your account at any time, for any reason, without notice or refund. Reasons include but are not limited to:
- Violating these Terms
- Uploading prohibited content
- Copyright infringement
- Suspicious or fraudulent activity
- Any reason we deem appropriate
You may cancel your subscription at any time by contacting us at the email address below. However, no refunds will be issued for unused time or services.
13. Dispute Resolution
Any disputes will be resolved through binding individual arbitration, not in court. This means:
- No jury trials
- No class action lawsuits
- Disputes handled by a neutral arbitrator
- Arbitrator's decision is final
Exception: You may pursue claims in small claims court if they qualify.
14. Governing Law
These Terms are governed by the laws of the State of Michigan, USA. Any legal proceedings must be brought in Michigan state or federal courts.
15. Entire Agreement
These Terms, along with our Privacy Policy, constitute the complete agreement between you and VidPulsar. They supersede any prior agreements or understandings.
